About The Case

What is this case about?

Between March 2011 and May 2014, defendants William Sears (“Sears”) and Scott Dittman (“Dittman”) conspired to commit securities fraud and wire fraud through FusionPharm, Inc. (“FusionPharm”).  Specifically, Sears and Dittman reported to the public that certain sales transactions and revenues for FusionPharm had occurred when, in fact, they had not.

This was an investment fraud scheme and most investors didn’t receive any earnings from the scheme and lost their investment.

What is forfeiture?

Forfeiture occurs when a court of law declares the proceeds of a crime to be the property of the government.

What is remission?

Remission is the process by which forfeited assets are returned to the victims of the crime underlying the forfeiture.  Authority to grant remission rests with the United States Attorney General, as delegated to the Money Laundering and Asset Recovery Section of the U.S. Department of Justice.  The remission process is set forth in the Code of Federal Regulations, Chapter 28, Part 9 (2019).

How was my check amount calculated?

The amount of each victim’s recovery was equal to the approved petition amount, which is the petitioner’s eligible loss.

The address on my check is incorrect and I can’t cash it -- what shall I do?

Please mail the original check to the Remission Administrator at the address at the top left of your check, along with a letter containing your name, and new address and ask to have your check reissued.

Why didn’t I receive the whole amount I claimed?

If your petition was partially granted, some of the most common reasons for this are:

Fees and commission were deducted from investment amounts and the net amount was granted.

Amounts claimed were only granted if acceptable supporting documentation was provided.
